Shiv Sena under Uddhav Thackeray receives court approval for a gathering on Dussehra

NewsDesk, Sept 23 -The Uddhav Thackeray-led Shiv Sena was granted permission by the Bombay High Court on Friday to stage its yearly Dussehra demonstration at Mumbai’s renowned Shivaji Park on October 5. Since the BMC, Mumbai’s civic body, had previously denied the party permission to hold the demonstration, the decision represents a significant victory for the Thackeray side.

The Thackeray and Eknath Shinde factions of the Sena were both denied permission by the BMC on Wednesday to hold the demonstration in Shivaji Park, the court was informed.

A division bench of Justices R D Dhanuka and Kamal Khata granted the Thackeray-led party use to the ground from October 2 to October 6 while requesting that it uphold law and order, claiming that the BMC order was a “clear abuse of process of law and bonafide.”

Both Shiv Sena groups had requested to hold a Dussehra protest at Shivaji Park, but Mumbai’s civic authorities, the BMC, had previously been unable to grant them permission due to worries over peace and order. Once the Bombay High Court had heard the petitions brought by the opposing factions today, it made its decision regarding the landmark venue issue. RD Dhanuka and Kamal Khata, two judges who sat on a division bench, issued the ruling.

Although Uddhav Thackeray promised on Wednesday that the rally would take place in Shivaji Park, the Thackeray camp has also requested permission from the BMC to host its gathering at the MMRDA grounds. The Shivaji Park police station’s comments that “if any one of the applicants is granted permission to hold the rally, this may cause a significant problem of law and order in the sensitive region of “Shivaji Park”” were highlighted by the BMC in its letters rejecting the applications.

The Bombay High Court stated in its order, “Video recording of the entire function will be done, and if it is found that petitioners are responsible for creating any law and order situation, it will affect their permission in the future.” The High Court then directed the Uddhav-led Shiv Sena to present this order to the BMC ward officer and seek permission again in accordance with the 2016 GR.
